Terms of Use

1. Who these terms are between

These terms are an agreement between you and Ahmet Can Güven, an independent developer based in Istanbul, Türkiye ("we"), the publisher of the Umber app for iPhone and Apple Watch, its widgets, its Siri shortcuts and this website. By installing or using Umber you accept them. If you do not, please do not use the app. Apple's standard licensed application terms also apply and take precedence where they conflict.

2. Not medical advice

Umber is a general wellness tracker. It is not a medical device and is not intended to diagnose, treat, cure, prevent or predict any disease or condition. Charts, correlations, counts and AI companion replies describe your own logged data; they are not clinical assessments and can be incomplete or wrong. Always consult a qualified clinician before making decisions about medication or care, and seek urgent help for a sudden, severe or unusual headache. Umber is not for emergencies.

3. Your licence

We grant you a personal, non-transferable licence to use Umber on Apple devices you own or control, under the App Store rules. You may not copy, modify, reverse-engineer, resell or misuse the app or its services, or use them in a way that harms other people or our systems.

4. Free features

Logging attacks, symptoms, medication, food and check-ins, the calendar and history, the 7-day pressure view, and export of all your data are free, without a time limit and without an account. They remain available if a subscription ends, is refunded or is cancelled.

5. Premium, trials and billing

Premium is available as an annual subscription ($49.99 a year, with a 7-day free trial), a monthly subscription ($8.99 a month, no trial) or a one-time purchase ($129.99). Prices are in US dollars; the App Store shows the price in your currency, which may differ, and may include tax.

Payment is charged to your Apple account at confirmation of purchase. A subscription renews automatically at the end of each period at the same price unless you cancel at least 24 hours before it ends. The free trial converts to a paid annual subscription at its end unless cancelled before; the app sends one reminder two days before. You can manage or cancel in Settings › Apple ID › Subscriptions on your device. Cancelling stops future charges; the current period runs to its end. Unused portions of a period are not refunded by us; refund requests go to Apple, which decides them under its policies.

Only one annual price is shown to you at a time. Prices may change for new purchases; an existing subscription keeps its price unless Apple asks you to agree to a new one.

6. AI companion and credits

The AI companion is available after you accept its consent screen. It uses credits: a monthly allowance is included with a subscription (150 with annual, 100 with monthly; the allowance resets each month and unused credits do not carry over), the one-time purchase includes 500 credits once, new users receive 15 credits to try, and additional credit packs can be bought. Purchased credits do not expire. Credits have no cash value, cannot be transferred, and are refundable only through Apple. We may adjust how many credits a request costs, and we may suspend the companion for maintenance or safety; when we do, nothing is charged. The companion is a language model and can be wrong; it is not a clinician and is bound by the same "not medical advice" rule as the rest of the app.

7. Your data

Everything you enter stays yours. We take no licence over it beyond what is needed to run the features you use, as described in the Privacy Policy. You can export it at any time. Keeping a backup is your responsibility: if you delete the app and have iCloud off, your diary is gone and we cannot restore it.

8. Availability and changes

Local features work without our involvement. Online features (forecasts, purchase verification, the AI companion) depend on Apple, RevenueCat, OpenAI and our own server and may be interrupted. We may change or retire features; if a change removes something you paid for, you may request a pro-rata refund from Apple. We may update these terms; the app shows you material changes before they apply.

9. Disclaimers and liability

Umber is provided "as is". To the extent the law allows, we make no warranties about accuracy, availability or fitness for a purpose, and we are not liable for indirect or consequential loss, or for decisions made on the basis of information in the app. Nothing here limits rights you have as a consumer that cannot be limited by contract, or liability that cannot be excluded by law. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim.

10. Ending the agreement

You can stop using Umber at any time by deleting it. We may end your access to online features if you abuse them; your local diary and export remain available.

11. Governing law

These terms are governed by the laws of Türkiye, without affecting mandatory consumer protections of the country you live in. Disputes go to the courts of Istanbul, unless your local law gives you the right to your own courts.
